Is This Person Making a Legitimate Argument on Banning Smoking in Public Places?

I recently got into a debate, i personally think smoking should be allowed in public, he does not. I said banning smoking in public spaces curtail individual liberty and the right to pursue happiness, and that the argument for smoking bans revolving around health risks is ridiculous; Passive smoking, or secondhand smoking can impose health risks on others, but so can automotive exhausts, paint fumes, and typical pollutants. So i asked him, ought the government regulate all these too? He said no, and i said hes view regarding this matter is inconsistent. He then goes on to equate smoking in public places with public nudity, and even taking dump on the public street. I personally think he is making a whole new case, is he making a legitimate argument or making a whole new case? And what do you think about banning/regulating smoking on public places?

you are correct, automobiles and trucks cause much more emissions than tobacco

especially diesel vehicles
