In terms of the alphabet at least, we are about half way through our A to Z guide on the subject of electronic cigarettes. In this chapter we will look at what is perhaps the biggest of themes surrounding the e cigarette’s whole existence. If you haven’t yet read the previous chapters, please feel free to check them out.
The word “legal” is not an uncommon word but when it comes to the matter of the electronic cigarette it has proved absolutely crucial in several ways. The legality of this alternative to smoking tobacco cigarettes has been the cause of great controversy, not just here in the UK, but worldwide.
Different countries have made their own specific rulings and it’s worth looking at in greater detail, as what may apply in one country, may not apply in another. Let’s deal with the situation in the UK first. At the time of writing this article, the use and the distribution of electronic cigarettes in the United Kingdom has no restrictions. So here at least, it is perfectly legal to buy, sell and use the product. It is however worth noting that investigations are ongoing into the device and things could change at any time.
Perhaps due to the state by state set up, the United States is also one of the most complicated situations regarding the e cig. In some states, the product is outlawed, whilst in others such as, especially of interest, California, it is currently legal to distribute, purchase and use the product. Governor Arnold Schwarzenegger, himself got involved and vetoed a bill attempting to ban the sale of electronic cigarettes, believing that if adults wanted to use the device and were aware of any potential health risks that she be able to do so. The overall picture in the States appears to be ultimately in the hands of the FDA (The Food and Drug Administration) who seem to be treating the e cig as a tobacco product despite the absence of tobacco in it.
In Brazil, there is currently an outright ban on the sale and importing of the product, while in other countries such as New Zealand, the electronic cigarette can only be sold as a registered medicine. In Holland, the e cig can be distributed and used but any advertising of it is currently strictly prohibited.
Whatever country you are in, it’s worth find out what the legal status is before shipping in your brand new e cigarette.
